Regulations on the safety management of hazardous chemicals
(issued by the State Council on February 17, 1987)
Chapter I General Provisions
Article 1 These Regulations are formulated in order to strengthen the safety management of hazardous chemicals, ensure safe production, ensure the safety of people's lives and property, and protect the environment
Article 2 all units and individuals that produce, store, deal in, transport and use hazardous chemicals within the territory of the people's Republic of China must abide by these regulationsArticle 3 the dangerous chemicals referred to in these Regulations refer to the standard GB of the people's Republic of China ××××— 86 explosives, compressed gases and liquefied gases, flammable liquids, flammable solids, spontaneous combustibles and inflammables in wet conditions in the classification standards specified in "classification and name and number of dangerous goods". Oxidants and organic peroxides, poisons and corrosives
if there are special provisions in radioactive substances, civil explosives, gunpowder, explosives, ammunition, initiating explosive products and nuclear energy materials in the weapon industry, as well as national laws and administrative regulations, the relevant provisions of the State shall prevail
Article 4 units that produce, store, operate, transport and use hazardous chemicals must establish and improve the safety management system of hazardous chemicals Article 5 the production enterprises, warehouses, special stations and wharves of hazardous chemicals must be located in safe places Article 6 the State Council and the local people's governments at all levels can dynamically adjust the rate of change. The relevant departments of the government are responsible for the implementation, supervision and inspection of these regulations according to the scope of their duties. Chapter II production and use of hazardous chemicals Article 7 the state has unified planning and strict management of the production of hazardous chemicalsthe State exercises strict control over the construction, expansion and reconstruction of enterprises producing highly toxic and dangerous chemicals
Township, town and street enterprises are prohibited from producing highly toxic chemicals
Article 8 the construction, expansion and reconstruction of enterprises producing dangerous chemicals must be examined and approved by the people's government at or above the provincial level (including the provincial level) where they are located, and the examination and approval procedures must be performed in accordance with the relevant provisions of the state Article 9 the construction, expansion and reconstruction of local enterprises producing highly toxic and dangerous chemicals must be examined and approved by the people's governments of the provinces, autonomous regions and municipalities directly under the central government where they are located and reported to the Ministry of chemical industry for the recordArticle 10 enterprises that build, expand or rebuild hazardous chemicals must submit the following documents to the approval unit:
(I) design assignment (including process, plant layout, surrounding buildings, residents within a kilometer around the plant, etc.)
(II) physical and chemical properties of raw materials, intermediate products and final products
(III) technical requirements for storage, transportation and packaging
(IV) industrial health, safety and environmental protection evaluation
(V) emergency measures for dealing with disastrous accidents
the examination and approval unit must review with the local departments of chemical industry, public security, health, environmental protection and labor
after the completion of the project, the relevant units shall organize the units participating in the review to conduct completion acceptance, and the project can be put into operation only after passing the acceptance
Article 11 enterprises that build, expand or rebuild dangerous chemicals must hold the technical data of product ignition point, spontaneous ignition point, flash point, explosion limit and toxicity measured by the provincial chemical research (inspection) department, apply to the chemical administrative department of the province, autonomous region and municipality directly under the central government for a production license, and register with the administrative department for Industry and Commerce in accordance with the relevant provisions Article 12 enterprises that produce and use hazardous chemicals shall, according to the types and properties of hazardous chemicals, set up corresponding safety facilities such as ventilation, fire prevention, explosion prevention, poison prevention, monitoring, alarm, cooling, moisture-proof, lightning protection, anti-static, isolation operation, etcproduction enterprises should establish fire control and first aid organizations as needed
Article 13 enterprises that produce dangerous chemicals must strictly implement the laws and regulations on the quality of industrial products to ensure that the product quality meets the standards set by the stateArticle 14 the pressure vessels used by enterprises in the production of dangerous chemicals must comply with the relevant national regulations on pressure vessels, and should be regularly maintained and monitored
Article 15 the packaging and marking of dangerous chemicals must comply with national regulations
packaging supervision and inspection institutions should strengthen the supervision, inspection and regular testing of packaging quality and packaging materials
Article 16 units and individuals that produce and use dangerous chemicals must abide by various safety production systems and operating procedures, and strictly implement the fire management systemArticle 17 when producing and using dangerous chemicals, safety protection measures and appliances must be taken
Article 18 containers containing dangerous chemicals must be checked before and after use to eliminate hidden dangers and prevent fire, explosion, poisoning and other accidents
Article 19 devices for the production of dangerous chemicals shall be sealed and equipped with necessary explosion-proof and pressure relief facilities
the production of toxic substances should be equipped with safety and industrial health facilities such as monitoring, alarm, automatic interlocking, neutralization and elimination
Article 20 enterprises that produce and use hazardous chemicals must properly treat waste water, waste gas and waste residue in accordance with the provisions of the environmental protection lawArticle 21 safety measures shall be taken to destroy and dispose of waste hazardous chemicals with combustion, explosion, poisoning and other dangers, and the consent of the local public security and environmental protection departments shall be obtained. Chapter III storage of hazardous chemicals Article 22 hazardous chemicals must be stored in special warehouses, special sites or special storage rooms (cabinets) and managed by special personnel
the production workshops and distribution stores of hazardous chemicals can set up a revolving warehouse of hazardous chemicals as needed, and the storage limit is stipulated by the local competent department and the public security department
stations and wharves of transportation departments should build special warehouses to store dangerous chemicals. If it is really difficult to build a special warehouse and it is necessary to store dangerous chemicals in general warehouses for a short time, a certain safe distance shall be maintained and stored in isolation
Article 23 the special warehouse for hazardous chemicals shall comply with the relevant safety and fire prevention regulations, and shall be equipped with corresponding safety facilities such as ventilation, explosion prevention, pressure relief, fire prevention, lightning protection, alarm, fire extinguishing, sun protection, temperature regulation, electrostatic elimination, and protective Bund according to the type and nature of the goods
Article 24 the storage of hazardous chemicals shall meet the following requirements:
(I) hazardous chemicals shall be stored by classification and item by item, and there shall be a safe distance between the main channels of stacking, and excess storage is not allowed
(II) dangerous chemicals that are easy to burn, explode or produce toxic gases in case of fire or moisture shall not be stored in open air, damp, leaking rain and low-lying places prone to ponding
(III) dangerous chemicals that are easy to burn, explode or produce toxic gases under the sun, and flammable liquids and gases such as barrels and cans should be stored in a cool and ventilated place by pressing the "impact" button
(IV) dangerous chemicals with conflicting chemical properties or protection and fire extinguishing methods shall not be stored in the same warehouse or the same storage room
Article 25 dangerous chemicals must be checked and registered before warehousing, and they should be checked regularly after warehousing
Article 26 the processing technology has reached the leading level in the industry. Smoking and open fire are strictly prohibited in the warehouse where dangerous chemicals are stored. Fire prevention measures must be taken for motor vehicles entering the warehouse area
Article 27 warehouses storing dangerous chemicals shall be equipped with fire-fighting forces, fire-fighting facilities, communication and alarm devices in accordance with the fire control regulations
Article 28 the State implements a business license system for dangerous chemicalsit is forbidden to deal in dangerous chemicals without a license
Article 29 An enterprise that deals in dangerous chemicals must meet the following conditions:
(1) have business facilities that meet safety requirements
(II) have technicians who are familiar with the profession
(III) there is a corresponding management system
Article 30 enterprises that build, expand or rebuild hazardous chemicals must apply to the local commercial bureau at or above the county level (including the county level); After being examined and approved by the local commerce bureau in conjunction with relevant departments, the business license shall be issued by the commerce department (bureau) of the province, autonomous region or municipality directly under the central governmentthe commercial departments (bureaus) of provinces, autonomous regions and municipalities directly under the central government should review the business license together with relevant departments every two to three years
Article 31 the circulation of dangerous chemicals shall comply with the following provisions:
(1) the planned distribution of dangerous chemicals shall be supplied as planned
(II) chemical hazardous substances from normal supply and demand channels outside the plan shall be supplied according to the contract
(III) hazardous chemicals temporarily needed by the user shall be purchased with the certificate issued by the competent department at or above the county level (including the county level) (indicating the variety, quantity and purpose)
(IV) sporadic chemical hazardous substances that are needed in daily life and whose purchase volume does not exceed 500 grams or 500 milliliters (except those with special limits) can be purchased directly from operating enterprises. Chapter V transportation, loading and unloading of dangerous chemicals Article 32 the transportation of dangerous chemicals must be handled in accordance with the relevant national regulations on the administration of the transportation of dangerous goods. For those that do not meet the requirements, the consignor shall not consign them, and the transportation department shall not carry them
Article 33 the transportation, loading and unloading of hazardous chemicals shall comply with the following provisions:
(I) handle with care to prevent impact, dragging and dumping
(II) chemical dangerous goods that are easy to cause combustion, explosion or other hazards due to collision and mutual contact, as well as chemical dangerous goods with conflicting chemical properties or protection and fire-fighting methods, shall not violate the loading restrictions and mixed shipment
(III) for dangerous chemicals that are easy to cause combustion, explosion or toxic gas when exposed to heat or moisture, heat insulation and moisture-proof measures shall be taken during shipment
Article 34 when transporting dangerous chemicals, passengers and goods shall not be mixed
passenger trains, ships and aircraft cabins shall not carry dangerous chemicals
passengers are not allowed to carry or carry dangerous chemicals on the above means of transportation
Article 35 irrelevant personnel are prohibited to take the carriage, cabin and aircraft cabin carrying dangerous chemicals
Article 36 when passing through the urban area, vehicles carrying dangerous chemicals (except trains) shall abide by the driving time and route stipulated by the local public security organ, and shall not stop at will
Article 37 samples or reagents of small quantities of inflammable and explosive dangerous chemicals urgently needed for quality inspection or scientific research can be consigned by express under the condition of ensuring safety. Chapter VI penalty provisionsArticle 38 for units that violate the provisions of these regulations, depending on the seriousness of the circumstances, the local people's government or relevant competent departments shall order them to improve within a time limit or stop production or business for rectification; If it still fails to meet the specified requirements after rectification, its production license or business license shall be revoked
Article 39 the relevant departments in charge shall impose administrative penalties on the relevant personnel who violate the provisions of these regulations according to the seriousness of the circumstances, which constitutes a crime
